Pop-Up Play SA is a toddler entertainment business based in Kloof, Kwa-Zulu Natal, South Africa. By booking one of our services or packages offered, you are agreeing to the following:
- It is your responsibility as the client to ensure that you have the adequate space available to accommodate the package that you have chosen. Our packages are adequate for both indoor and outdoor use; however we do recommend that a shaded space is utilised as the soft play equipment can get hot and unpleasant in the sun.
- Due to the nature of our setups, it is a requirement for venues to be easily accessible for both setup and collection. It is your responsibility as the client to ensure this.
- Access to the venue is required at least one hour prior to your start time. Pop-Up Play SA will not be held responsible for late setups as a result of venues that are difficult to access or are a challenging distance from the parking area.
- Pop-Up Play SA reserves the right to refuse or cancel a booking due to an unfeasible venue that is a challenge for the Pop-Up Play SA team to set up – such as that which requires the Pop-Up Play SA team to go up and down many stairs with our equipment.
- You, as the client, are required to confirm your party start and end times at least one week prior to your party date.
- You, as the client, are solely responsible for the safe keeping of the equipment provided by Pop-Up Play SA for the duration of your event. If our products are misused or damaged, the client will be held responsible for the costs or full replacement thereof. Our Soft Play equipment is not waterproof. Should the equipment be out in the open when it starts to rain, you are required to move it undercover.
- Our soft play equipment is designed for toddlers up to the age of 5 years old. To prevent damage, we request no bigger children or adults play on the equipment.
- Additionally no shoes are to be worn and pets are not to play on the equipment.
- Payment terms are 50% to confirm your booking and final 50% 24 hours before the day of the event taking place.
- We regret no refunds on your booking payment will be made due to cancellations. Cancellations and refunds are at the discretion of Pop-Up Play SA.
- Pop-Up Play SA will not be held liable or responsible for any theft, injuries, loss, or damage caused as a result of play on / with any of our packages or products. Children are the sole responsibility of their parents / guardians and as such, they are required to monitor them at all times when at play.
- With our Messy Play, all ingredients used are taste safe and non toxic, there is still however a choking risk. Parents / guardians are advised to discourage their children from trying to place any items in their mouths.
- Pop-Up Play SA will not be help responsible or liable for any allergic reactions to any food or play substances touched or tasted.
- By booking with Pop-Up Play SA, you consent to your child and others participating in play options presented by Pop-Up Play SA and you do so at your own risk as their parent / guardian / party organiser.
- Social Media Waiver – We may take photographs,
videos and/or audio during events to post on our social media, website or newsletters. We are the sole owner of any Media and may use the Media in any way. - You consent to having any Media taken of you and your child for the use in any form of media and/or publicity material produced or printed by Pop-Up Play SA, without any right to inspect or approve such Media.
- Personal Information – You agree that any personal information shared with Pop-Up Play SA will be used in accordance with Pop-Up Play SA’s Privacy Policy.
- Governing Law – South African law. These Terms and Conditions shall be governed by the laws of the Republic of South Africa.
